This Legal Notice governs access to and use of the website elebaa.com (hereinafter, the «Website»), owned by Random Lifestyle Group, SL (hereinafter, «elebaa»).

Access to the Website confers the status of user and implies full and unreserved acceptance of all the provisions included in this Legal Notice, as well as in the Privacy Policy and the Cookies Policy published at the time the user accesses the Website.

3. Nature of the service

elebaa is a private digital platform that hosts content generated by its members. It operates as a verified, invitation-only environment comprised exclusively of adults.

elebaa does not organize physical meetings, does not mediate relationships, does not perform background checks beyond the identity system, and does not guarantee the behavior of its members.

elebaa acts as an accommodation service provider in accordance with applicable European regulations.

4. Terms of use

The user agrees to use the Website in accordance with the law, this Legal Notice, other published conditions and policies, and generally accepted rules of conduct.

The use of the Website for illicit purposes, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload or impair the Website, its contents or its services is prohibited.

The user shall refrain from obtaining or attempting to obtain the contents of the Website by means or procedures other than those made available to him.

5. Intellectual and industrial property

Content generated by members within the platform remains the property of each author. By sharing it on elebaa, the member grants a non-exclusive license limited to what is necessary for its hosting, display, operation, moderation, and legal compliance within the platform.

6. User-generated content and responsibility for it

elebaa acts as a hosting service provider with respect to the content published by its members, in accordance with Article 16 of the LSSI-CE and Regulation (EU) 2022/2065 (DSA).

elebaa does not systematically review all published content beforehand, but acts diligently once it has actual knowledge of a possible infringement, either through its internal notification system or by any other reliable means.

elebaa has a notification and action system accessible to any user who wishes to report content they consider illegal or contrary to the terms of use.

7. Moderation and complaint mechanisms

When elebaa makes a decision that involves restricting content or an account, the affected member will receive information about the general reason for the decision, the rule violated, the measure taken, its duration where applicable, and the available review options.

The member may submit a free internal appeal within 15 days of notification of the decision. The review will be conducted, where possible, by someone other than the person who made the initial decision. elebaa will respond within a reasonable timeframe.

All of this is without prejudice to the extrajudicial or judicial resolution mechanisms available under the DSA.

8. Links to third parties

The Website may contain links to third-party sites. elebaa assumes no responsibility for the content, privacy policies, or practices of third-party websites. Access to such sites is at the user’s sole risk.

9. Limitation of liability

elebaa does not guarantee the continuous and uninterrupted availability of the Website and will not be liable for damages resulting from interruptions, errors, omissions, computer viruses or disconnections in the operation of the system.

elebaa is not responsible for the conduct of its members outside the platform, for in-person meetings, or for personal decisions made by users. This is without prejudice to the mandatory rights granted to consumers by applicable law.

elebaa takes reasonable technical security measures, but no system can guarantee absolute protection.

10. Data protection

11. Applicable law and jurisdiction
